This panel will bring together leaders from across the country to discuss how lawyers, courts, law schools, and bar associations can help to close the access to justice gap through innovations in the legal market, and tap into the 80% of the US population with legal problems who are currently not receiving any legal services, and often times are operating outside of the legal system.
Objectives:
Justice Himonas -
Will focus on the Utah approach to the A2J challenge, focusing primarily on (1) our authorization of Licensed Paralegal Practitioners and (2) regulatory reform through rule changes (including 5.4) and the implementation of a regulatory sandbox.
Professor Sandefur -
Will speak about the research evidence base that supports the conclusion that reforms such as those in Utah can both increase access to justice and protect consumers.
Zack DeMeola -
Will discuss the IAALS Unlocking Legal Regulation project, including:
- IAALS role in serving as a resource for states, lawyers, courts, and the public and how it is filling that role:
- A summary of activity around the country on regulation innovation and reform, including proposals and action taking place in Arizona, California, Chicago, DC, and with APRL, and IAALS activity in these places
- IAALS resources available online, including our Knowledge Center
- Model regulation being developed through collaboration with Utah, how risk-based regulation works, and how states are approaching alternative business structure regulation:
- Comparison between Utah and Arizona models that are being developed now
- Comparison between the Utah sandbox and the California recommendations for sandbox regulation
Will discuss the Foundations for Practice project, and how regulation innovation and reform may affect legal education
- Brief summary of Foundations for Practice and opportunities for schools in the future
