Since the State passed legislation in 2020 to sunset the “Transfer Act”, CT’s Department of Energy and Environmental Protection (DEEP) has been working with stakeholders to develop the replacement “Release-Based” program. This arduous process has led to many questions about implications of the transition to the regulated community and property owners. Initial draft program regulations were expected to be issued by the end of 2023, which will provide a more tangible understanding of what exactly the new program will require, how it will work, and how it will potentially affect and intersect with a variety of other, existing environmental requirements in CT.
