The Defend Trade Secrets Act of 2016 provided parties a private right of action for asserting trade secret misappropriation in federal courts. Yet, the DTSA did not preempt trade secret misappropriation claims from being brought under state law. This has led to a rise in case filings involving trade secret misappropriation claims, while also creating new and different methods for assessing damages.
